What is the process to sell a house I've inherited? Should I sell? What are my options? What will the house sell for? Do I need to go through a probate court process to sell? These are the questions I hear most, and we'll go through each one together.

What's the difference between a trust sale and a probate sale?

It depends on who holds title and what authority they have. Your attorney confirms which path applies. Here's the general shape, straight from California law.

California Courts Self-Help Guide: Overview of formal probate

Probate with full IAEA authority

Probate with full IAEA authority

Probate with full IAEA authority

A personal representative with full authority may sell real property (Prob. Code §10511).

A Notice of Proposed Action (form DE-165) goes out at least 15 days before the sale (§10586).

If someone objects in writing, the sale goes through court supervision (§10589).

Probate with court confirmation

Probate with full IAEA authority

Probate with full IAEA authority

Required with limited authority (§10501(b)) or no IAEA authority.

The court confirms the sale before title passes (§10308); the offer must be at least 90% of appraised value (§10309).

Others can overbid at the hearing (§10311).

Trust sale

Probate with full IAEA authority

Trust sale

A trustee has the power to sell trust property, at public or private sale (Prob. Code §16226).

The trust document and your attorney set the steps; beneficiary notice rules can apply (§16061.7).

My job is to take as much of the stress off your hands as I can and guide you through the sale from start to finish. Where it makes sense, and when the personal representative or trustee approves, light, return-focused prep can help the home show its best.

Common questions

Do I need court approval to sell?

It depends on the authority in your Letters and whether the property is in a trust. Your attorney will confirm; the paths above link to the code sections.

Can we fix the house up before selling?

Sometimes. Spending estate or trust money is a decision for the personal representative or trustee, with their attorney. I'll give you options and costs so you can decide.

Do you work with our attorney?

Yes. I keep your attorney in the loop and work within the notice or court timeline they set.

Should I sell, or keep the house?

That's your family's decision, made with your attorney and tax advisor. I can show you what the home would likely sell for as-is and after light prep, so you're deciding with real numbers.
