CALIFORNIA HOMEOWNERS · NOTICE OF DEFAULT

Got a Notice of Default? Here's what it means.

Plain-English information about the notice, a list of official resources, and, if selling turns out to be your best path, a licensed agent who can list and sell your home.

Please read first

I'm a licensed real estate agent. I can help you list and sell your home.

I am not an attorney, lender, loan-modification company, or foreclosure consultant.

I am not affiliated with any lender, loan servicer, or government agency.

I cannot stop or postpone a foreclosure, and I make no promises about outcomes.

I charge no upfront fees.

WHAT THE NOTICE SAYS

Time matters. Read the notice closely.

California requires a Notice of Default to begin with an "Important Notice." Among other things, it tells you:

  • You may be able to bring the loan current by paying past-due amounts plus permitted costs, normally until five business days before the sale date.
  • No sale date may be set until approximately 90 days after the notice is recorded.
  • You and your lender may agree in writing to more time or a payment schedule.
  • You may offer your property for sale, as long as the sale closes before the foreclosure is completed.
  • If you have questions, contact a lawyer or the government agency that may have insured your loan.

Red flags under California law

PROTECT YOURSELF

California's foreclosure-consultant law bars consultants from taking these steps. If someone asks you to, slow down and get advice.

  • Collecting any fee before every promised service is fully done.
  • Asking you to sign over your deed or an interest in your home.
  • Asking for a power of attorney.
  • Asking for a lien or other security for their fee.
  • Offering to collect your foreclosure surplus funds for a cut.
